Step 4. Return the original papers to the clerk

Once the Motion has been delivered to the other party, the original papers must be returned to the Clerk’s Office with proof that the papers were delivered to the other party.  (If you mailed the papers, you need to fill out the “Certification” section of the motion.)   If a marshal delivered the papers, the marshal needs to complete the “Return of Service” section of the Motion

If the judge granted you a fee waiver, you must return the granted application with the Motion. Check with the marshal to find out if service has been made and if the marshal will return your motion with the return of service section completed, or if you must get the forms from the marshal and return them to the court. Make a copy of the fee waiver for your records. 

Also, you should ask the clerk if you are required to call the clerk’s office to mark the case “ready” before the hearing date.
