If you don't agree with DEW's determination about your claim, you have the right to appeal the decision. You can appeal by completing a Notice of Appeal to the Appeal Tribunal Form (APP-100) or writing an appeal letter explaining your disagreement with the determination. Your appeal form or letter must include your name and Social Security number. You can send in your appeal by mail or fax, or file it electronicly through DEW's MyBenefits portal.
You must file your appeal within the deadline for it to be considered! You must file your appeal within ten calendar days of the mailing date listed on the determination. Be aware, that this is ten days from the mailing date--not ten days from your receipt of the determination. If the tenth day falls on a weekend or state or federal holiday, the appeal period extends to the next business day.
The appeal can be sent to:
Address:
S.C. Department of Employment and Workforce
Appeal Tribunal
P.O. Box 995
Columbia, SC 29202
Fax: 803-737-0287
It is a good idea to keep proof of the date you sent in the appeal in case it is lost or misplaced. That way you can show that you sent it in on time. Proof could include a mail receipt, if you sent the appeal in by certified mail, or a fax confirmation sheet.
