Under the law, just filing the Notice of Civil Appeal with the circuit court does not automatically prevent law enforcement from executing the Writ of Ejectment. You also must file a document that says that you agree to pay the rent as it comes due. This document is called a "Bond" or an "Undertaking." Once you sign and file this Bond, then the execution of the writ of ejectment must be stopped. Also, the Bond requires you to pay your rent within five (5) days of the due date. If you do not pay the ongoing rent within five days of the due date, then the landlord can notify the court, and the appeal will be dismissed.
The language that the Bond should include has been drafted by the S.C. General Assembly and has been set out in the landlord tenant code.
