Since they get so many complaints, the Attorney General cannot follow up every one. If they can follow up your complaint, they may:
- get you your missing wages,
- file a criminal or civil case against your employer, or
- both.
If the Attorney General cannot follow up your complaint, you can take your employer to court. But you must file a complaint with the Attorney General before you start your case in court.
If you want to take your employer to court, you must wait 90 days from the date you file your complaint. This will give the Attorney General's office time to look into your complaint.
If 90 days have passed, and you have not heard from the Attorney General, you can take your employer to court. Use the Legal Resource Finder to see if you can find a lawyer to help. Or, you can go to court on your own.
If your employer owes you $7,000 or less, you may be able to go to Small Claims court. Many people in Small Claims court do not have a lawyer. Find Small Claims court information and forms on the court's website.
