A guardianship is a legal process in probate court which appoints someone with the legal authority to take over life decisions for another individual. In order to obtain a guardianship, you must prove to the court that the individual who would be under the guardianship is not able to understand things well enough to make or communicate decisions concerning their life or property.
In some situations, a guardianship is the best choice to protect an incapacitated person’s rights; however, it is important to look into all of the alternatives to guardianship before filing one in probate court because guardianship actions are expensive and very restrictive for an individual.
