Defending Debt Collection Cases in S.C. Circuit Courts
Steps you'll need to take
What Creditors Assume That May Not Be True
Creditors and the lawyers who collect for them often make assumptions about you and the debt they are collecting. These assumptions may not be true and such wrongful assumptions are important when you respond to a their collection efforts. They can be especially important when you respond to a lawsuit about about the debt.
Here are some typical assumptions creditors and their lawyers make:
1. The debt is yours
2. You haven't paid the debt
3. You won't answer the lawsuit, so they'll get an easy judgment against you with little or no evidence
4. If you do answer, they will get an easy judgment because courts often aren't strict about the evidence they require
5. You don't know that you have exemptions from paying a judgment so they can convince you to make payments.
6. You don't know that your wages can't be garnished in S.C. for a consumer debt like this so they can convince you to make payments.
