Preserving Heirs Property in S.C./Quieting Title and Partition
Steps you'll need to take
Coming to an Agreement Among the Heirs When All Are Identified
If the heirs are determined and you have their addresses, its best to try to reach an agreement. This can be in the form of:
1. A Family Agreement, or
2. A Family Trust
You need an attorney for either one of these because, even when the parties agree, the agreement must be put in writing and a determination made as to how the property or any proceeds from sales or other income will be handled.
You can use the Heir Worksheet forms included here to gather the information the attorney will need.
