It is recommended to have a Sheriff in the county where the Respondent can be found serve the papers on the Respondent . There will be a separate service fee (usually $50.00 (fifty dollars) in Wyoming).
You can contact the Sheriff's department in the county where the Respondent lives to determine the fee charged by the Sheriff. This also applies if the Respondent lives out of state.
1. You will need to provide the Sheriff in the county where the Respondent resides with a file-stamped copy (one of the copies that you had stamped by the Clerk of Court when you filed the Petition) of the Petition to Modify Custody and Child Support, Summons, and Confidential Statement of the Parties for Child Support Order. These are the forms that the sheriff will give to ("serve on") the Defendant.
2. Once the Defendant has been served, you MUST FILE the original Summons and Return (or Affidavit) of Service (the Return of Service is page 2 of the Summons) with the Clerk's office.
- This is to show the Judge that proper service was made. This proves to the Court that the other party has been notified of your request for modification of child support.
