If you cannot find all of the heirs, you cannot get everyone's agreement. If you cannot get everyone's agreement, that means nothing can be done with the property that requires the owner's signature. A lawsuit to partition the property may be needed.
1. If a partition action is filed, a guardian ad litem can be appointed by the court to protect the interest of anyone who is an unknown heir, who cannot be found; or who is under age.
2. In a partition action, the Court requires that you meet a high standard of due diligence in trying to locate all potential heirs.
3. All heirs must be served with the partition action. This can be difficult if you don't have addresses or they have moved.
