As the plaintiff or initiator in a divorce, you may not know where to start. On the South Carolina Legal Services LawHelp page, you will be able to find self-help automated forms which provide you with instructions on filing fees, court information, and checklists. This is an important step as it provides information and helpful tips to ensure a seamless experience. Below is the link to the PDF dictating instructions for the plaintiff for how to proceed throughout this process. As well, there is a link to the self-help automated interview process for plaintiffs in the same situation. The automated interview process walks you through an interview to determine whether you qualify for help. In order to qualify for help, you and your spouse must be residents of South Carolina for at least 3 months, have no shared debts or debts that need to be adjudicated (or brought in front of the judge). This also includes possible child-rearing or visitation problems as to qualify for the forms, there must be no issues to be ruled on by the judge.
